Terms of Use

1. Agreement

These Terms of Use govern your use of goodepickens.com and our related email communications (together, the "Site"), operated by Goode Pickens, LLC ("Goode Pickens," "we," "us" or "our"). By using the Site or joining our email list, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Our email list

Joining our list is free. It does not place an order, reserve product or create a contract to buy or sell anything, and it does not guarantee availability, pricing, delivery, pickup locations or event space. Products, prices, subscription terms and pickup locations will be offered separately, and any purchase will be governed by the terms we provide at that time. We may change, delay or discontinue any planned product, service, market or event at any time.

3. Information on the Site

We describe our farm, flock and plans in good faith. Descriptions of our farming practices, timelines, products and events reflect our current plans and may change. Site content is for general information only and is not nutritional, medical or other professional advice.

4. Farm visits and events

The farm is private property. Visits are by invitation or advance registration only. Farm Days and other on-farm events are subject to separate event terms, which may include a release of liability that you must sign before attending.

5. Our content

The Site's text, photographs, illustrations, design, logos and the Goode Pickens Farms name are owned by or licensed to Goode Pickens, LLC and are protected by law. You may view the Site and share links to it for personal, noncommercial use. You may not copy, modify, distribute or use our name, logo or photographs for any other purpose without our written permission.

6. Acceptable use

You agree not to:

  • Submit false information or sign up another person without their consent.
  • Interfere with, disrupt or attempt to gain unauthorized access to the Site or our systems.
  • Use bots, scrapers or other automated means to access the Site or collect information from it.
  • Use the Site for any unlawful purpose.

7. Third-party services

The Site uses and links to services we don't control, including MailerLite, Instagram and Facebook. Their own terms and privacy policies apply, and we are not responsible for their content or practices.

8. Disclaimer

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, GOODE PICKENS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOODE PICKENS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnity

You agree to indemnify and hold harmless Goode Pickens, LLC and its members, managers, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.

12. Changes

We may update these Terms from time to time by posting a new version here with a new effective date. Your continued use of the Site after a change means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
